Receivership is the process whereby the holder of a floating charge may appoint an insolvency practitioner to take charge of, and realise, the assets of a company.
Since the introduction of the Enterprise Act 2002, the ability of floating chargeholders to appoint receivers has been substantially curtailed. Often administration will be the chosen insolvency regime. However, receiverships are still a live issue in Scottish insolvency and the MacRoberts Corporate Recovery team has many years experience in dealing with receiverships in Scotland.
