We defend our clients from the initial point of contact with investigators through to any hearing at court. Our specialist team will liaise with investigators and prosecutors throughout an investigation and protect our client’s position, including representing clients at interviews with investigators. Acting for a wide-ranging client base, from sole traders to global corporate companies, we assist our clients following investigations by regulatory bodies including the Office of Rail and Road (ORR), Crown/Crown Prosecution Service, Scottish Environmental Protection Agency, Police Scotland and DVSA.

We provide advice following ORR improvement/prohibition/enforcement notices and local authority notices, such as for noise, litter and graffiti. We advise our clients throughout inquests or fatal accident inquiries, including advocacy, and provide support for employees being interviewed either under caution or voluntarily. We present defence of enforcement action by any other regulator, such as Police for Corporate Manslaughter and the Health & Safety Executive, in situations where they may regulate rather than ORR, and civil sanctions regimes/paper submissions and appeals. Our team also provides non-contentious advice regarding risk assessments.
