Before the Coronavirus (Scotland) Act 2020 came into force on 6 April 2020, tenants under a commercial lease could be evicted for non-payment of rent on as little as 14 days’ notice using irritancy procedures.

As part of its response to the pandemic, the Scottish Government increased the 14-day period to 14 weeks. This increased period was due to be kept in place until 30 September 2020. However, the Scottish Government is currently considering wheter to keep the 14-week period in place until 31 March 2021.
