Government & Public Sector

Accounting for almost 19% of UK employment, the public sector employs over two million people in both local and central government, and nearly half a million others in a variety of public bodies.

The global economic crisis has put intense pressure on government to tackle budget deficits and huge debt burdens, which has led to tighter budgets and a squeeze on public spending. Competition for public contracts is fierce and bidding costs are high, meaning that private sector players are increasingly looking for legal support in fine-tuning their bids on major public projects. In addition, with devolved powers continuing to develop, there is further scope for change in areas such as welfare and tax, adding both opportunity and complexity.

At MacRoberts, we have a deep understanding of these issues and the many other challenges and opportunities facing the public sector, and recognise that you need an established, cross-disciplinary legal team to meet your requirements.

We work with a diverse range of public bodies and non-departmental public bodies across the whole of Scotland and our team advises a range of matters including:

  • Governance issues
  • Public sector project work
  • Outsourcing and implementation of services
  • Innovative use of statutory powers
  • Competition law
  • Data protection and intellectual property
  • Education and employment

Our clients include a range of city and county councils, local authorities and government bodies.

We enjoy a long-standing relationship with the Scottish Government, having previously worked on the acquisition of Glasgow Prestwick Airport by the Scottish Government and the Forth Bridges maintenance project for Transport Scotland.  We have also recently been appointed to the Scottish Government’s legal panel framework after a rigorous competitive tendering process, securing places on two framework panels covering corporate and commercial contracts and major projects.

We are also part of the “Developing Markets for Third Sector Providers” programme delivered by the Ready for Business consortium. This is a partnership involving leading support providers to the third sector and public sector in Scotland, advising on a range of issues to help meet the needs of Scotland’s public sector.
